California Toyota Lemon Law Attorney
Tundra V35A engine recall, Tacoma brake fluid leaks, door actuator failures, oil consumption. Jeff Le Pere knows the Toyota defense playbook from the inside. Free review. Statewide.
California’s Song-Beverly Consumer Warranty Act covers every Toyota sold or leased in the state with a manufacturer warranty still in effect. That includes the Tundra, Tacoma, 4Runner, Highlander, Camry, RAV4, Sienna, Sequoia, and the full Toyota hybrid lineup. The 2024 V35A engine recall, Tacoma brake fluid leaks, door lock actuator failures, and persistent oil consumption are all common qualifying defects. Toyota pays the attorney fees on successful claims.
Does California Lemon Law Cover My Toyota?
Yes. Every Toyota sold in California with a manufacturer’s written warranty falls under the Song-Beverly Consumer Warranty Act. The protection covers gas, hybrid, and plug-in hybrid Toyota models. It applies to new Toyotas, used Toyotas still inside the original warranty, and certified pre-owned Toyotas with their own written warranty. Whether you bought outright, financed, or leased, the protection runs the same.
The Tundra, Tacoma, 4Runner, Highlander, Sequoia, Land Cruiser, Camry, RAV4, Sienna, Prius, and the Crown lineup are all covered. Toyota hybrid models (RAV4 Hybrid, Highlander Hybrid, Camry Hybrid, Prius) carry an additional federal hybrid-component warranty on top of Song-Beverly, providing extended coverage on the high-voltage battery and hybrid powertrain.

Common Toyota Defects We See in California Lemon Law Cases
Tundra & Sequoia V35A Engine (Recall 24V-410)
The 3.4L V35A twin-turbo V6 in 2022–2024 Tundra and 2023+ Sequoia has manufacturing debris that damages bearings and causes engine seizure. Toyota recalled approximately 102,000 vehicles in 2024. Engine replacement is the recall remedy, and a replacement on a near-new vehicle is itself a substantial impairment of value.
Tacoma Brake Fluid Leaks (2024–2025)
Brake master cylinder and proportioning valve issues causing brake fluid loss. A safety defect under California Civil Code §1793.22, which qualifies on the lower two-attempt threshold rather than four attempts.
Door Lock Actuator Failures
Documented across Tundra, Tacoma, 4Runner, Camry, and Sienna. When the actuator fails, the door may not lock, may not unlock, or may operate intermittently. Repeated dealer attempts that fail to resolve the issue qualify under Song-Beverly.
Excessive Oil Consumption
Toyota TSBs acknowledge oil consumption in 2.4L, 2.5L, and certain V6 engines. Owners report needing to add a quart or more between scheduled oil changes. Repeated failed repair attempts qualify as substantial use impairment.
Hybrid System & Battery Issues
High-voltage battery degradation, inverter failures, and hybrid system error codes on the Toyota hybrid lineup. Covered by both the federal hybrid warranty and California's Song-Beverly Act when dealer repairs fail.
Infotainment & Electronics
Persistent screen freezes, Apple CarPlay/Android Auto failures, backup camera glitches, and parasitic battery drain across the Toyota lineup. When repairs fail repeatedly, these issues qualify as non-safety defects under the four-attempt threshold.

Your Toyota May Qualify If
- Two or more failed repair attempts for a safety defect like V35A engine failure, brake fluid leaks, or sudden loss of power.
- Four or more failed repair attempts for the same non-safety defect, such as oil consumption, door lock actuator failure, or persistent infotainment issues.
- 30 or more cumulative days out of service for warranty repair within your first 18 months or 18,000 miles.
- A failed Toyota recall remedy. If the recall fix did not resolve the defect, the recall service counts as a failed repair attempt. The 24V-410 V35A recall is a particularly strong qualification pattern.
- An engine, transmission, or hybrid component replacement under warranty. Major component replacement on a near-new vehicle is itself a substantial impairment of value.
- Repeated dealer visits documented as “could not duplicate” for a defect that later proves real.
