Does California Lemon Law Cover My Tesla?
Yes. Every Tesla sold in California falls under the Song-Beverly Consumer Warranty Act. The protection applies to new Teslas, used Teslas still inside the original warranty, and certified pre-owned Teslas — whether you bought outright, financed, or leased.

Common Tesla Defects We See in California Lemon Law Cases
Autopilot / FSD Phantom Braking
Autopilot and Full Self-Driving have drawn federal scrutiny and widespread phantom-braking complaints — hard braking for no real obstacle — plus unexpected steering and disengagements. Unexpected braking is a safety defect that qualifies on the lower two-attempt threshold.
Suspension & Control-Arm Failures
Premature front and rear suspension failures — control arms, fore-links, and knuckles — across the Model S, X, 3, and Y, causing clunking, misalignment, and in severe cases loss of control. A safety-related defect when unresolved.
MCU / Touchscreen Failure
The Media Control Unit's eMMC memory can wear out and disable the center touchscreen, which controls climate, backup camera, charging, and defrost. Because it governs safety functions, a failure Tesla cannot resolve substantially impairs use.
Battery & Charging Faults
Sudden range loss, charging restrictions, and battery-management faults that limit charging or power beyond normal degradation, and that Tesla cannot restore, qualify under the Battery & Drive Unit warranty and Song-Beverly.
Water Leaks & Build Quality
Water intrusion causing electrical faults or corrosion, and body or glass defects that impair use or safety, can qualify — the test is substantial impairment of use, value, or safety, not cosmetics alone.
Doors, Glass & 12V Failures
Falcon-wing door malfunctions (Model X), door-handle failures, cracked glass roofs, and repeated 12-volt battery failures that strand the vehicle. Repeated failed repairs qualify under California lemon law.

Your Tesla May Qualify If
- Two or more failed repair attempts for a safety defect like phantom braking, a suspension failure, or sudden loss of power.
- Four or more failed repair attempts for the same non-safety defect, such as a touchscreen failure, charging faults, or water leaks.
- 30 or more cumulative days out of service for warranty repair within your first 18 months or 18,000 miles — including mobile-service and service-center time.
- An over-the-air update meant to fix a defect that failed to resolve it. A failed OTA fix counts as a repair attempt and does not reset the clock.
- A battery, drive unit, or major component replacement under warranty. Major component replacement on a near-new vehicle is itself a substantial impairment of value.
- Repeated service visits documented as no fault found for a defect that later proves real.
